William Bearde, probate 8th August 1580

In the name of God Amen/ the eighte daye of Julie in the yeare of our Lorde god/ 1580/ and Anno Regni Regine [in the year of the reign of queen] {4} Elizabeth 22nd I William Bearde of Bearde in the Countie of Darbie gentleman sicke in bodie but of good and perfecte remembraunce thankes be geven to god doe hearein declare my last will and testament in maner and forme followinge/ First I commende my soule to almightie god my maker and redemer and my bodie to be buryed in the parisshe Churche of Glossoppe before the queere in the same Churche/ Item my will is That Emme Bearde now wife of me the said william shall Immediatelye from and after my decease have holde occupie and enjoye the house or capitall messuage whearein I the said william doe now inhabitte and dwell commonlye called Bearde hall with all maner buyldinges gardens yardes orchardes landes tenementes meadowes leasowes pastures woodes waters commons turbaries Rentes herriottes duties easementes and services whatsoever to the said hall of Bearde belonginge or in any wise appertayninge as fullie and in as ample maner as I the said william have hearetofore occupied and injoyed the same for and duringe all the life naturall of my saide wife Item my will is that after the decease of my saide wyfe my said hall of Bearde with all other my landes tenementes buyldinges orchardes gardens meadowes pastures woodes waters commons turbaries rentes duties heriottes and services whatsoever shalbe used occupied imployed and bestowed to the uses [true?] {1} intentes and purposes of me the said william Bearde in this my last will expressed and declared in maner folowinge That is to saye my will is that myn executours shall of the issues and proffettes of my said Landes tenementes and all other the premisses whatsoever receyve perceive leavie and take the Summe of niene hundreth poundes for and towardes the preferment in mariage of Elizabeth Bearde Emme Bearde and Katherinne Bearde doughters of me the said william/ The which Summe of niene hundreth poundes my will is myn executours shall equallie and trulie devide into three partes that is to saye to everye of my [saide] {7} doughters three hundreth poundes a peese/ which said summe of niene hundreth poundes my will is my saied executours shall bestowe upon my said doughters to the uses above wrytten uppon the daye of their severall mariages yf so muche monye shalbe by myn executours reysed and had uppon myn whole landes and hereditamentes, And yf not, then to be payed at suche dayes and tymes as the same wilbe raysed and had in and upon my said landes accordinge to the discretion of my saied executours as myn especiall trust is in theim Item my will is That if my said doughters Elizabeth Emme and Katherinne Bearde or any of theim shall fortune to bestowe theimselves in mariage withoute the consente lykinge and good will of my said wife if she be than lyvinge and of myn executours or the more parte of theim That then my said doughter or doughters bestowinge theimselves in mariage as above written shalbe satisfyed with suche Summe or or summes of moneye in respecte of the mariage money as to my saide wife and myn executours or the more parte of theim shalbe thoughte conveniente/ and the rest and residewe or her or their parte of mariage moneye so maryinge theimselves withoute the consente of my saied wife and myn executours/ to be devided and bestowed upon suche my doughter or doughters as shalbe ruled and advised by my saied wife and myn executours Any clause or article declared in this my last will or testamente to the contrarie notwithstandinge Item my will is that if god call for anie of my said doughters before they comme to mariage or shall have receyved the Summe of three hundreth poundes That then the saide money to her or theim due shalbe equallie devided betwixte myn other two doughters lyvinge or to suche my doughter as shall happen to survive/ Item my will is that all suche charges as myn executours shalbe putte unto by meanes of any sutes or trouble that may arrise or growe or which myn executours shalbe putte unto by reason of the dewe execution of this my last will and testament shalbe discharged and aunswered of the issues and proffettes of my saide landes over and besydes the charge of the nyene hundreth poundes for my doughters mariages/ Item my will is further that after the saide sumes of niene hundreth poundes be geathered receyved and had upon my landes by myn executours as before said And all suche other chardges as shalbe disbursed paide and done by theim That then my said hall of Bearde and all other my buyldinges landes tenementes orchardes gardens meadowes woodes waters leasowes pastures commons turbaries rentes herriotes dutyes and services whatsoever to be and remayne to the righte heires male of me the said william Bearde forever/ Provided alwayes and my full will mynde purpose and intente is that if it fortune the righte heires malles of me the said william to molest or trouble or cause to be molested or troubled my said executours so that they can not employe and bestowe the issues and proffettes of my landes and tenementes to the uses hearein expressed and discharge the trust by me in theim reposed/ That then and from thensefoorthe the righte interest tytle clayme and demaunde in and to my said landes and tenementes limited and appoynted to the said heires males by vertue of this my last will and testamente to cease and be utterly extincte and determyned And my saide hall of Bearde with all and everie the buyldinges landes tenementes meadowes pastures leasowes woodes waters commones turbaries rentes dutyes heriottes and services whatsoever to be equallie devided amonge my said doughters then lyvinge/ anye thinge hearein written to the contrarie in any wise notwithstandinge Item my will is that if anye of my said doughters shalfortune to be bestowed in mariage duringe the naturall lyfe of my said wife [theire mother] {7} and that my said doughter or doughters be maried by and with the consente of my saied wife their mother and all or the more parte of myn executours Then my saide wife shall geve and bestowe uppon her or theim so beinge maried suche a reasonable portion of goodes over and besydes their mariage money as to my saide wife and executours shalbe thoughte conveniente/ Item my will is that my welbeloved tenantes shall peaceablie and quietlye withoute any molestacion of myn heires or executours have holde occupye and enjoye all suche tearmes and bargaynes of their severall tenementes as they have by and from me eyther for yeares or lyves payinge their yearely rentes at the feaste dayes appoynted and doynge suche dutyes and services as by their Indentures theye are bounde to doe/ Item wheareas Thomas Bearde had of me by Indenture of lease amongest other thinges the one halfe of Robyne medowe to him the said Thomas Grace his wife and william their sonne and to the longest lyver of theim Now the said Thomas hath exchaunged the said halfe of Robyne medow with me for one other medowe called car medowe now in the tenure of the said Thomas/ The said thomas havinge none assuraunce thereof/ my will thearefore is That the said Thomas Grace his wife and william their sonne and the longest lyver of theim shall have and enjoye the said car medowe duringe the lyves naturall of theim the said Thomas Grace and william and the longest lyver of theim/ Item I geve and bequeathe to my servaunte Rauffe bearde two yewes Item I geve to my servauntes Peter Smyth Thomas Kynder william Bearde Anne purlane {a} and Ellen Ridge everie one of theim one yewe sheipe Item I geve to Grace garret one cowe styrke Item I geve to my syster the wife of Roberte Swyndels one Incalfe heffer Item I geve and bequeathe to everye one of my systers doughters one yewe hogge/ Item I geve to everie one of my godchildren twelve pence/ Item I geve my doughter Emme bearde my ringe of golde Item I geve to my doughters Elizabeth and Katherin eyther of theim ten shillinges in golde Item I geve to everie one of myn executours tenne shillinges in golde/ Item my will is that peter Smyth my servaunte after the deathe of his father shall have the house whearein his said father now dwelleth with thappertenances duringe the lyfe of the said Peter. Item my will is that all my dettes payed my funerall and legacyes discharged all the rest of my goodes to remayne and be at the governaunce and disposicion of my said wife/ Item I geve and bequeathe to John Bradburie one Cowe styrke Item I geve and bequeathe to Roberte Nowell one baye mare which was Rauffe hydes and one cloke furred with foxe Item I geve to richard Sylvester the younger one yewe hogge/ Item wheareas Ellen Platte wydowe now holdeth of me one messuage or tenement with certayne landes meadowes and pastures thereunto appertaynynge commonly called highill for and duringe the lyfe of the said Ellen which said tenement with all and everye the appertenances I the said william Bearde have dimised and leased to william Bennet of Buggesworthe latelye deceased and his assignes for certayne yeares nexte after the deathe of the said Ellen Platte as by the same Indenture of lease more at large it dothe and may appeare/ for the avoydynge of contention that may aryse towchinge the same messuage or tenement my will is that the same and all and everie the appertenances be equallie devided immediatelye after the deathe of the said Ellen platte by myn executours or somme others at their appoyntement/ wheareof Thurstone plat to have the one halfe of the tenemente so devided and to paye the one halfe of suche rentes and doe suche dutyes as are dewe thearefore/ And the assigne or assignes of the said william Bennet to have the other halfe and to paye suche rentes and dutyes as are dewe for that Moytie/ And after the deathe of the said Thurston platte my will is That all the said messuage and tenement together with the appertenances comodytees and proffettes whatsoever whollie doe remayne to the assigne or assignes of the said william Bennet duringe the yeares in the Indenture of lease made by me the said william Bearde to the said william Bennet/ Also my will is That the said Thurston shall not demise or sette over the said halfe of highill or anye parte theareof to any persone or persones but tothe assigne or assignes of the said william Bennet his assignes/ Payinge therefore at the oversighte of my said Executours or the more parte of theim/ And yf it fortune any controversye to aryse betweene the said thurstone and the assignes of the said Bennet that any of theim interrupte others from the quyet possession of their severall partes devided as before said So that they may not peaceablye injoye the same/ That then he or they so interruptinge others or causynge theim melested or interrupted to forfette his or their estate of the premisses to the partie or partyes so Interrupted Item wheareas one Peter Tyndale of Brotherton in the Countye of yorke with others have entred a sute agaynst me in her Majesties high Courte of Common pleas at westmynster upon an Obligacion of one hundreth poundes for non payment of £60 the forfyture of which obligacion the said Peter and other seeke to charge me with by lawe I Joe protest before god and the worlde that I never sealed nor delyvered anye obligacion byll or wrytynge whatsoever to one John Nevell to the use of Sir Anthanie Nevell Knyghte as by the said Peter tyndall and others is untruly alledged/ Fynallye I will and requyre my trustye and welbeloved wife Emme Bearde Randulphe Davemporte esquier Lawrence Stafforde and Richarde Rowe gentlemen to see this my last will and testamente in all thinges fullye executed and performed as myn especyall trust is in theim These beinge wytnesses william Platte thelder Rauffe meller Thomas Bearde thelder Thomas Bearde the younger Laurence hyde with others
