Nicholas Garlecke, probate 14th February 1566 [1567] {5}

In the name of the father and of the Son and of the holye Gooste three parsons and one Eternall verye lyvynge god. I nycholas Garlecke of Thornsett in the Countye of derbye gentleman beynge of good and perfytt mynde and Sounde Remembrance make declare and ordeygne the fyrst day of August in the yeare of oure lorde Jesus chryste a thousand fyve hundrethe threscore and foure and in the Syxte yeare of the Reygn of oure Soverayne ladye quene Elezabethe my Testamentt and last wyll by theise presenttes in wrytynge in Maner and forme folowynge/ Fyrste I Bequethe my Soule to god almyghtye besekynge and hopynge by the medyacion and meyrettes of my Savyour Jesus chryste [to enjoye] {7} in Soule and bodye at the Eternall Resurreccion the Felycytye and blysse of heaven in the Communion of Sayntes and I wyll my bodye to be buryed wheare yt pleasethe god and the dyscreycion of my executores maye Apoynte hit/ And for that I have ben A greate traveler in the worilde and have hadd dyvers doynges And weyghtye Affayres under Thomas late duke of norffolk and my lord thomas haward his yonger Son so that I have bene dyverse tymes putt in feare that for Matteres of Accompte and other dewtyes or demaundes to or by theym my landes tenementtes and heredytamenttes shoulde or myghte be putt by theyr meanes in execucion or otherweys charged or Incumbred wheruppon I have hadd at dyverse tymes wrytynges and devyses made in wrytynge which I have often sayde or wryten to have bene executyd by me altoughe non of theym never weare so effectuallye made and executyd by me or in my behalffe but that I lawfully and justlye maye (notwithstandynge Anye of the sayd wrytynges) devyse and declare this my last wyll and testamentt of all my sayd landes tenementes and heredytamentes or of Anye parte of them as I do and wyll devyse by theise presenttes and therfore have levyed A fyne of my sayd landes tenementes and heredytamentes with ther Appurtenances to Anthonye Gell and other persons in the terme of holye trynytye in the fourthe yere of the Reygn of our sayd Sovereygne ladye the quenes hyghnes that nowe ys [1562] {5} wheruppon and also for that all my sayd landes tenementes and hereditamentes with ther Appurtenances be holden by me by and in socage tenure or servyce or the nature of Socage tenure or servyce and neyther in Capyte [in chief] {4} nor by or in knyghtes servyce or tenure or the nature of Anye knyghtes servyce or tenure as I have dylygentlye serched Inquered and perceyved. And also to Avoyde all contencions Ambyguytyes questyons and doubtes that myghte by Margarett my dysobeydyentt doughter or on her behalffe be movyd or hadde. who I doo the more myslyke and can have no good hope of/ for bysydes other her mysbehavyours I do with saynt paule Affyrme she haythe lost or cast Awey her former faythe and creydence and yche parte of the confydence that boythe my most dearlye belovyd son in lawe wylliam nedham her husband reposed in her/ and that I conceyved and most fatherlye oftentymes exorted and Admonyshed her to contynewe in/ wherfore and for that I do respectyvelye regarde and have delyberatlye with all due Cyrcumstances examyned my Consyence and procedynges Concernynge this my testamentt and last wyll to be made done and hadd Accordynge to and in the feare of god his holye lawes and blessed wyll and Accordynge to the lawes of this Realme/ I the sayd nycholas garlecke do by this my testament and last wyll ordeygn declare devyse dyspose and wyll aswell that all and synguler my landes tenementes and heredytamentes with ther Appurtenances in hardwyckewall and hill in the paryshe of Tyddiswall in the sayd countye of derbye shalbe and goo to Agnes my wyffe for terme of her lyffe in Full and playne contentacion and Recompence of all and yche maner of dower and Joyntour that she can or myghte have clayme or demaunde of all or Anye of my landes tenementes or heredytamentes with ther Appurtenances As Also all other the Resydewe of all my landes tenementes and hereditamentes with thappurtenances Imediatlye After my decease/ and the sayd landes tenementes and hereditamentes with thappurtenances in the sayd hardwyckwall and hyll Imedyatlye After my sayd wyffes decease shalbe and go to the executors of this my last wyll and thatt they shall take and have the yerely Renttes issues and proffettes of all the same my tenementes and hereditamenttes with thappurtenances withowte Anye waste or spoyle to thuse and behofe of the honest educacion Sustentacion or maryage of the eyght doughters of the sayd wylliam nedham by my sayd doughter begotten untyll my sayd executores have therof and therfore Reyceyved the Some of fyve hundrethe poundes money to be hadd towardes the sayd eyght doughters exhibicion Sustentacion or Maryage/ And I also wyll that my sayd executores discreytion shall not onelye dyrectt and ordre the Receyvynge and bestowinge of the sayd fyve 100 powndes money for and to the sayd eyght doughteres or suche of them as do not marye/ but by the consent and Advyce of my executores and Feoffes or the more parte of them than lyvynge but Also that my executores so far forthe as thie lawfullye maye shall procure forther and doo that my sayd dysobeydyent doughter and her husband nowe shall dulye yelde content and peye to everye one of the sayd eyght doughteres all that to Anye of theym is or shalbe dewe ment or Intendyd by for or uppon the last wyll and testamentt of my sayd Sone in lawe wylliam nedham or otherweys/ And also I wyll and devyse to george nedham Second Son of the sayd william nedham one Annuytye or yerelye Rentt of foure poundes yerelye to be perceyved and taken of all the sayd landes tenementes and hereditamenttes of me the sayd nycholas Garlecke/ To have and to holde the sayd Anuytye or yerelye Rentt to the sayd George nedham frome and After the feast of thannuntiacion of our ladye [25th March] {5} which shalbe next After the sayd george nedham shall Accomplyshe thage of twentye yeares for and durynge the naturall lyffe of the sayd George to be payd at the feastes of saynct Mychaell tharchangell [29th September] {5} and thannuntiacion of our ladye by evyn porcyons durynge the sayd terme/ And further I wyll and devyse that yf yt fourtune the sayd yerelye Rentt of foure poundes in parte or in all [to be?] {2 behynde and unpayd at Any of the sayd feastes at which yt ought to be payd that than yt shalbe lawfull to the sayd George nedham and to his Assignes to entre and distreygn in and uppon all my sayd tenementes and hereditamentes and the dystresse to Reyteygn untyll he be of the sayd Anuytye or yerelye Rentt and everye parcell therof fullye Satysfyed contentyd and payd with tharrerages therof yf Anye suche be/ And I also gyve dyspose devyse and wyll to otuell nedham Son and heyre of the sayd wylliam nedham and to theyres males of the bodye of sayd otuell lawfullye begotten and for lacke of suche yssue to the sayd George nedham his brother and to theyres males of his bodye lawfullye begotten and for defaulte of suche yssue to the Ryght heyres of the sayd Otuell nedham all and Synguler my landes tenementes And hereditamenttes with thappurtenances and everye parcell of the same Savynge Alweys and evermore provyded that my sayd wyffe and my sayd executores and the sayd George nedham shall have severallye yche and everye maner of parte and parcell interest tytle and proffett in the sayd landes tenementtes and hereditamenttes with the Appurtenances as is in Anye wyse in this my wyll devysed wylled mentioned or mentt to Anye of theym/ And evermore provyded and also X declare devyse ordeygne and wyll that my sayd dysobedyent doughter or Anye person in her behalffe shall not in Anye wyse have or medle with Anye parte or parcell of my sayd landes tenementtes and hereditamenttes with thappurtenances nor with Anye Inherytaunce proffytt tytle or interest of or in the same/ and Also I devyse ordeygne and wyll not onelye that my executors and feoffies or persons to whome the sayd fyne was levyed or hadd and everye of theym shall have theyre resonable costes charges and exspences which Anye of theym shalbe at or Susteygne for or Abowte this my wyll or Anye thynge therin or for or Abowte the defence of my sayd tenementtes and hereditamenttes in Anye wyse and that the sayd costes charges and exspences shalbe taken levyed and hadd by my [sayd] {7}executores and feoffeis or of Anye of them of the yerelye renttes issues and proffettes of my sayd landes tenementtes and hereditamenttes with thappurtenances without Anye wast or spoyle to be done/ but also that all leasses and termes made or herafter to be Made by me by wrytynge under my Seale to Anye person or persons of Anye of the sayd landes tenementtes or hereditamenttes wheruppon or wherbye the Accustamed yerelye Renttes [evermore?] {2} be Reserved to me and to my heyres or to the heyres of the sayd Otuell or George nedham shalbe good and effectuall Accordynge to the wordes and entent of everye the sayd lease withowt Anye lett disturbance or hynderance of Anye of my sayd executores feoffeis or of the sayd Otuell or George or of Anye other person or persons/ And Also I devyse and wyll yf Anye of all the sayd persons or Anye other person or persons dystoyrbe hynder or lett my sayd executores or feoffeis for or in the execution of this my wyll and testament [that?] {1} than the same person or persons that so dystrurbeth hyndrethe or letteth the sayd execucion shall lose and forfett all the Auctoritye power benyfyte tytle and interest that he or she haythe or mey have in or by this my wyll or Anye thynge therin and that my sayd feoffeis and executores shall at theyr pleasures sell and bargayne Awey the landes tenementtes and hereditamenttes and all the Ryght tytle demaunde benyfyt and profyt therof and therin frome the same person or persons that so dysturbeth hyndreth or letteth the sayd execucion So that the same person or persons that so dysturbeth letteth or hyndreth the sayd execucion never mey ne shall have Anye of the sayd tenementtes or hereditamenttes/ Evermore exceptyd and provyded that my sayd doughter in Anye wyse shall [have] {7} no maner of tytle Comodytye profyt demande or Advantage by Anye mater or thynge in this my wyll/ And I wyll my executores and Feoffeis shall dyspose and bestowe the same money and profett that shall or maye Aryse or be hadd by the sayd forfett or losse to and for the prefermentt of the sayd eyght doughters and so manye of them as than shalbe in lyffe/ And I also devyse ordeygn and wyll that at my costes and charges ther shalbe A stronnge and sure chest or cofer with dyvers stronnge lockes and keyes therto hadd stande and Reymeyne at my Cosen Otuell Alens howse in Tydeswall and that everye one of my executores and feoffies shall have keys to and for the sayd lockes and that the sayd yerely Renttes issues and proffettes of my sayd landes tenementes and hereditamenttes with suche parcelles of money as shalbe or go to the prefermentt of the sayd eyght doughters or Anye of them/ or to the performance of this my wyll shalbe putt and kepte safelye in the sayd chest and coffer under and with the sayd lockes/ to be kepte and dysposed dulye Accordynge to this my wyll and ententt to the sayd eyght doughters prefarmentt As is Abovesayd/ by the dyscreycion of my sayd executors and feoffeis/ And also I do geve and bequethe to the sayd Otuell nedham Son and heyre of the sayd wylliam and to the heyres males of the bodye of the sayd Otuell lawfullye begotten the possessyon and occupacion of my best Costyd Salte of Sylver and doble gylte with the cover to the same belonngynge/ and of my Seconde Salte of Sylver and parcell gylte standynge [uppon?] {1} foure lyttle pyllers of Sylver and of my best dozen of sylver Spones that have the Gote hedd {a} uppon the ende of everye one of them gylte/ And also of my Seconde dozen off Sylver spones that have uppon everye one of them theise [bresyn?] {2} G for my name/ and the sayd Otuell nedham to have the possessyon of all the sayd plate and Spones to hym and to the heyres males of his bodye lawfully begotten and for defaulte of suche yssue I devyse ordeygne and wyll all the possessyon and Occupacion of all the sayd plate and Spones and everye parcell therof to Remeyne goo and be to George nedham brother to the sayd Otuell and to the heyres males of the bodye of the sayd George lawfullye begotten/ provyded alweys and my full purpose meanynge and ententt ys that the sayd Otuell nedham and George nedham shall have the sayd plate and Spones as heyrelomes and standardes of howseholde and the same to Reymeane goo and be as is Aforesayd withowte Anye Maner of Alteracion exchaunge or Alyenacion to be made of the sayd plate and Spones or of Anye parcell therof by the sayd Otuell nedham and George nedham or by eyther of them or by Anye of the heyres males of the bodyes of them that by this my wyll shall and maye take profytt or benyfyte of the sayd plate and Spones or of Anye parte therof/ provyded Alweys and I devyse and wyll that Rychard nedham and henrye nedham his brother tow of my executores of this my wyll Imedyatlye After my decease shall have the Custodye and keapynge of the sayd plate and spones unto suche tyme as the sayd Otuell nedham shall fourtune to be Maryed and Also keape howse/ and than the sayd Rychard nedham and henrye to delyver the sayd plate and spones to the sayd Otuell nedham yff the same Otuell and Suffycyent Suretyes with hym than wyll and doo At the delyverye of the sayd plate and Spones to hym enter into and be bounden by oblygacion in the Sum of Fourtye poundes of lawfull englyshe money to the sayd Rychard nedham and henrye nedham that he the sayd Otuell shall use and leave all the sayd plate and Spones to goe Reymeane and be Accordynge unto the purporte Intent and meanynge in and of this my wyll/ And yf the sayd Otuell do Refuse and wyll not be bounden as is Above sayd/ than I devyse and wyll that the sayd Rychard nedham and henrye nedham shall deyteygn and keape all the sayd plate and spones unto suche tyme as the sayd George nedham shall come unto the Age of 21 yeres and be Maryed and also doo keape howse and than the sayd Rychard nedham and henrye nedham to delyver the sayd plate and spones to the sayd George nedham yf he and Suffycyent Suretyes with hym wyll and doo entre into lyke bonde to the sayd Rychard nedham and henrye nedham As ys Aforesayd to use and leave the sayd plate and spones and everye parte therof to Reyneane goo and be Accordynge to the purporte intent and [true?] {1} meanynge of this my last wyll/ And yf the sayd Otuell nedham and George nedham and eyther of them do Refuse to be bounden As ys Aforesayd and doo dye havynge no heyres males of neyther of ther bodyes/ than lyvynge/ than I wyll and devyse that betwene the sayd wylliam nedhara my son in lawe and hym that he wyll take the paynes to be A Coadiutour Counseylour eyder and Assyster to my Feoffies and to the executores of this my wyll and testament for the true executyon of the same and to and for the most proffytt and benyffytt of the sayd chyldren of the sayd wylliam nedham Accordynge to the true ententt and meanynge herof and for his paynes and travell to be taken therin I gyve and bequethe to the same thomas Sutton thre poundes Syxe shylynges eyght pence to be payd to hym by my sayd executores/ the Resydewe of my goodes not
