Edward Downes, probate 4th July 1571

Anno domini 1571

In the Name of god Amen the Seconde daye of Maye Anno domini 1571 I Edwarde dowries of Baldebearde in the parishe of glossoppe in the Countie of derbie Husbandman beynge in perffeitt Remembrances gyvynge Laude and presse unto allmyghtie god/ do ordein and Make this my presente Testamente and Laste wyll in Maner and forme followynge Fyrste I offer and beqethe my Sole unto allmyghtie god my onlie saviour and Redemer my bodie to be Buried in the churche of Tacsall in the Countie of Chester/ And where as I have one Messuage or tenemente sett Lyinge and beyinge in kynder nowe in the occupacyon of John downes my Eldeste Sonne and heare Apparante and one Rawffe Cele of kynder I wyll that Margarett my wyffe Have the thirde parte of the yerly Rente therof durynge all her Naturall Lyffe/ And Further it ys my wyll {a} that John downes my Eldeste sonne and hys heyres males Lawffullie begotton and to be begotton shall have and Inoye my said Messuage and tenemente sett Lynge and beynge in kynder Afforsaid/ And yf thafforsaid John downes my Sonne have no yssue Male of his bodie Lawffullie begotton and to be begotton in Matrimoney/ Then it ys my wyll that Robertt downes and Edwarde downes [my sones] {7} and there [heires] {7} Males shall have the Afforsaid Messuage and tenemente with Appurtenances And for the defaute of Suche yssue Male unto [Ottwell downes and Thomas downes my sonnes and] {7} the heyres Males of [Thomas Downes and Ottwell downes T] {1} my sonnes and for Lacke of suche yssue unto the heres Males of my blode and kyndred of [me] {7} the {b} said money of Englande paide by Robertt downes and Edwarde downes my sonnes unto John downes [and his heires executores and Assignes] {7} towardes the Maryage of his dowghtteres that [then] {7} thafforsaid Robertt and Edwarde and there heires Males shall have and Inyoe all the premysses Affore wrytton in as Ample maner as the said John shulde or owghte to have the same/ Also I wyll that Robertt downes my sonne shall have my Farme After my decesse Taken of Master Bearde durynge my terme/ So that Margarett my wyffe have Athyrde parte of my said farme durynge her Naturall Lyffe yf that she cannott Agree to dwell with Robertt my Sonne/ And where as I have taken A Farme and tenemente of Nycholas Bredburie of Ollersett in the Countie of derbie gentyllman unto me and my Assignes I wyll that Thomas downes my sonne and his Assignes shall have the proffeite and my hoole Covenante graunted by master Bredburie Afforsaid of the said farme and tenemente Cauled the Ravenslache/ And where as I have taken of master Robertt bredburie one Closse Cauled the Tyncker Crofte nowe in the occupacyon of thafforsaid [Edwarde] {7} downes the elder I wyll that Margarett my wyffe [and Edwarde downes my sonne] {7} shall have the said Leasse and the proffeitt of the Same durynge my Entereste and tytlie/ And Further whear as I have taken one other Closse of Nycholas bredburye of Ollersett my Landlorde Cauled the Cottefilde I wyll that Margarett my wyffe and Edwarde my sonne shall have the Covenante and graunte [therof] {7} durynge [my .... and?] {1} also X wyll that [where] {1} as I have taken one Closse of Master [Nycholas] {7} bredburie Cauled the Arroleshawe for dyveres yeres yette to Cume I wyll that Robertt downes my sonne shall have my Covenante and bargayne of the premysses durynge my terme/ Also I wyll that {c} [my Executoures under wrytton] {7} shall have [all?] {1} my Righte and entereste wyche I have in one closse hede Cawled the bromefildehede taken of master Robertt Bredburie durynge my Leasse/ And wheare as the said Robertt Bredburie hathe Receved £6 of Currente Money of England At the handes of me thaffor[said] {1} Edwarde downes the Elder yf the said Robertt Bredburie do notte paye the said £6 unto thafforsaid Edwarde downes his exect[ors] {1} or Assignes at or beffore the 25 daye of Marche {d} wyche shalbe Anno domini 1572/ then yt ys my Covenante to have one closse [to me my executoures and Assignes] {7} Cauled the Nether end of the brumefilde nowe in the occupacyon of thafforsaid Robertt {e} [bredburie] {7} for the terme of 18 yeres yette to Cume/ the wyche moneye or grounde I gyve to Margarett my wyffe and Edwarde my sonne/ Also I wyll that Margarett my wyffe and Edwarde dowries my sonne shall take upe £20 of my hoole goodes and paye unto Angneys my dowghtter [?] {2} in one hole yere [nextte] {7} After my deithe withowte fraude or Longer deley/ The Reste of my goodes Moveables and unmoveables my dettes paid my funerall dyscharged and I beynge onestlie broghte home I gyve and bequethe unto Margarett my welbeloved wyffe and unto Edwarde downes my sonne/ And of this my presente Testamente and Laste wyll I ordein and make my trustie and welbeloved frendes to be my Executoures Edwarde downes my Cossen and Robertt downes and Edwarde downes my sonnes/ and the supervisores hearof I orden and make {f} my speciall good Masteres wylliam Bearde of bearde and Robertt Bredburie of Ollersett gentyllmen to se that this my wyll and Testamente be performed in all Causes as my synguler Confideince and truste ys in theym thes wyttnesses Thomas Rawlynson the Elder {g}

And Further I gyve unto my supervisoures eyther of theym 3s. 4d.

Also I wyll that Margarett my wyffe And Edwarde downes my son shall have all my Corne
